These Terms of Use (“Terms”) govern your use of the Tip Top Air website (the “Site”). The Site is designed to help customers who were referred to Tip Top Air by a home warranty provider understand the service process, check claim status, and contact support.

By accessing or using this Site, you agree to these Terms.

Who we are

The Site is operated by Tip Top Air (“Tip Top Air,” “we,” “us,” “our”).

Who this Site is for

This Site is primarily for customers whose home warranty provider has assigned Tip Top Air to a claim/work order. The Site is informational and support-focused. Any general HVAC information is provided to help you understand the process.

What the Site provides (and what it doesn’t)

What we provide:

  • Process guidance (what to expect)
  • Claim-status lookups (when available)
  • Support contact options
  • General maintenance tips

What we do not control:
Your home warranty provider controls plan terms, coverage decisions, approvals/authorizations, and service fee requirements. Your plan agreement and your provider’s determinations are the source of truth.

Claim status tool and accuracy

For convenience.
Any claim status shown on the Site is provided for convenience and may not reflect real-time changes.

Use the right identifiers.
You are responsible for entering accurate claim/work order and related information.

If something looks wrong.
If the status tool doesn’t match what you were told, contact Tip Top Air support and we’ll help you understand the next step.

Scheduling, service, and communications

Service communications.
If you contact us (or we contact you) about scheduling, service updates, authorizations, parts, or completion, you agree we may communicate with you by phone, text, and/or email using the information you provide or your warranty provider provides.

No marketing required.
These communications are intended for service and claim support, not promotional marketing.

Message and data rates.
If you receive SMS/text messages, message and data rates may apply based on your carrier plan.

Payments and costs

Service fee and plan costs.
Any service fee, deductible, or plan-related charges are set by your warranty provider and plan terms.

Non-covered work.
If any work is not covered by your warranty plan, Tip Top Air will explain your options before proceeding.

Privacy

Your use of the Site is also governed by our Privacy Policy. Please review it to understand how we collect and use information submitted through forms and claim-support tools.

Intellectual property

Our content.
The Site and its content (text, graphics, logos, and layout) are owned by Tip Top Air or used with permission and are protected by applicable intellectual property laws.

Limited license.
You may view, download, and print portions of the Site for personal, non-commercial use related to your claim/support needs.

No reuse.
You may not reproduce, republish, distribute, or exploit Site content for commercial purposes without written permission.

Acceptable use

You agree not to:

  • Attempt to access claim information that is not yours.
  • Interfere with the Site’s operation or security (including probing, scanning, or testing vulnerabilities).
  • Submit false, misleading, or harmful information.
  • Use automated tools (bots/scrapers) to access the Site in a way that disrupts service for others.
  • Upload or transmit malware, harmful code, or unauthorized data.

Third-party services and links

The Site may reference or link to third-party sites (including warranty provider portals). Those sites are not controlled by Tip Top Air, and their terms and privacy policies apply.

Disclaimer of warranties

“As is.”
The Site is provided on an “as is” and “as available” basis.

No guarantee of uninterrupted access.
We work to keep the Site reliable, but we don’t guarantee the Site will always be available, error-free, or fully up to date.

No legal/coverage advice.
Information on the Site is not legal advice and does not replace your warranty provider’s plan agreement or official claim communications.

Limitation of liability

To the maximum extent permitted by law:

  • Tip Top Air will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the Site.
  • Our total liability for any Site-related claims will be limited to the amount you paid Tip Top Air specifically for Site access (if any). (In most cases, $0.)

This section does not limit any rights you may have under applicable consumer protection laws.

Indemnification

If you misuse the Site or violate these Terms and that results in claims against Tip Top Air, you agree to defend and hold us harmless from those claims, losses, and expenses (including reasonable attorneys’ fees) to the extent permitted by law.

Changes to the Site or Terms

We may update the Site or these Terms to reflect improvements or operational needs.

When we update these Terms, we will revise the “Last updated” date above. Your continued use of the Site after changes means you accept the updated Terms.

Governing law and venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute related to these Terms or the Site will be brought in the state or federal courts located in California, unless applicable law requires otherwise.
